RIGHT OF WITHDRAWAL

 

1. Introduction

Pursuant to Articles 52 et seq. of Legislative Decree No. 206 of September 6, 2005 (Consumer Code), as amended by Legislative Decree No. 209 of December 31, 2025 (transposition of EU Directive 2023/2673), a consumer who purchases goods or services through this website has the right to withdraw from the contract in accordance with the terms and conditions set forth below.

 

2. Right of Withdrawal – Physical Products (Hardware)

The consumer has the right to withdraw from the contract for the purchase of physical products within 14 (fourteen) days, without having to provide any reason and without incurring any penalty.

The 14-day period begins on the day the consumer, or a third party designated by the consumer, takes physical possession of the goods.

In the absence of evidence to the contrary, delivery is presumed to have taken place within 7 business days from the date of shipment, unless otherwise indicated by the carrier or the customer.

This presumption applies solely for the purpose of internally calculating the withdrawal period and may be rebutted at any time by the consumer by providing proof of the actual delivery date (e.g., confirmation from the courier, tracking notification, recipient's statement).

 

3. Right of Withdrawal – Digital Content and Software Licenses

For digital content not provided on a physical medium (software licenses, plug-ins, sample packs, and similar products), the 14-day withdrawal period begins on the date the contract is concluded.

You cannot exercise your right of withdrawal if:

  • the consumer has expressly consented to the supply of the digital content beginning during the withdrawal period;
  • the consumer has acknowledged, by means of an express statement, that they forfeit their right of withdrawal by giving such consent;
  • IK Multimedia has provided the order confirmation, in accordance with Articles 50(2) and 51(7) of the Consumer Code, with explicit reference to the loss of the right of withdrawal.

If even one of the above conditions is not met, the right of withdrawal remains in effect and may be exercised within the standard 14-day period.

 

4. How to Exercise the Right of Withdrawal

The consumer may exercise the right of withdrawal by completing the dedicated digital form available in the "My Orders" section of the website, indicating the order number, the products in question, and the contact method for receiving confirmation.

Upon submission of the notice of withdrawal, IK Multimedia will promptly send, on a durable medium, an acknowledgment of receipt containing the text of the notice, along with the date and time of transmission.

 

5. Refund

The refund will be issued within 14 days of the date of receipt of the notice of withdrawal, using the same payment method the consumer used for the initial transaction, unless otherwise expressly agreed.

For physical products, IK Multimedia may withhold the refund until it receives the returned goods or until the consumer provides proof of shipment of the goods, whichever occurs first.

 

6. Effects of Withdrawal

In the event of withdrawal from this contract, the consumer will be refunded all payments made to us, including delivery costs (excluding any additional costs resulting from the consumer's choice of a delivery method other than the least expensive standard option we offer), without undue delay and in any case no later than 14 days from the date on which we were informed of the consumer's decision to withdraw from this contract. This refund will be made using the same payment method used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise; the refund may be withheld until we receive the goods or until the consumer provides proof of having returned them.

If the consumer has already received the goods covered by the contract:

  • the consumer is required to return the goods or deliver them without delay and, in any case, within 14 days of notifying us of the decision to withdraw. The deadline is considered met if the goods are returned before the 14-day period expires;
  • the direct costs of returning the goods shall be borne by the consumer. These costs are estimated to be approximately equal to or greater than those incurred for the delivery of the goods;
  • the consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does NOT apply in the following cases:

  • the supply of digital content via a non-tangible medium, if performance has begun with the consumer's express consent and acceptance of the fact that, in such a case, they would lose the right of withdrawal;
  • the supply of sealed audio or video recordings or sealed computer software that have been unsealed after delivery.
